Aquatic Capital of America Foundation, a 501(c)(3) non-profit organization, was formed in 2008 by long-time resident and sailing enthusiast Tom Shadden and several influential friends as a destination for visitors interested in the many aquatic activities offered in the City of Long Beach, California. Their research confirmed a long-held belief by many residents that Long Beach has more produced more athletes, coaches and officials who have become Olympians, World and National Champions, and World and National Record breakers, than any other city in the U.S.A.
The founders seek to promote the myriad of aquatic activities offered in Long Beach, and to recognize, honor and support the huge legacy of its aquatic athletes, coaches, officials and organizations.
As the organization has grown, it is also working to promote water safety and education. The Foundation also supports community and regional efforts to cleanse local waterways as well as to increase the number of local aquatic facilities.

LIABILITY RELEASE

PARTICIPANT WAIVER AND RELEASE OF LIABILITY AGREEMENT
For and in consideration of Aquatic Capital of America (“ACOA”) allowing me, the undersigned, to participate in the 2021 Naples Island Swim race (“Event” “Events”); I, for myself, and on behalf of my spouse, children, heirs and next of kin, and any legal and personal representatives, executors, administrators, successors, and assigns, hereby agree to and make the following contractual representations pursuant to this Waiver and Release of Liability, Assumption of Risk and Indemnity Agreement (the “Agreement”);
1. I hereby certify and represent that (i) I am in good health and in proper physical condition to participate in the Events; and (ii) I have not been advised of any medical conditions that would impair my ability to safely participate in the Events. I agree that it is my sole responsibility to determine whether I am sufficiently fit and healthy enough to participate in the Events.
2. I acknowledge the inherent risks associated with open water swimming. I understand that my participation involves risks and dangers, which include, without limitation, the potential for serious bodily injury, sickness and disease, permanent disability, paralysis and death (from drowning or other causes); loss of or damage to personal property and equipment; exposure to extreme conditions and circumstances; accidents involving other participants ,event staff, volunteers or spectators; contact or collision with natural or manmade objects; dangers arising from adverse weather conditions; imperfect water conditions; water and surface hazards; facility issues; equipment failure; inadequate safety measures; participants of varying skill levels; situations beyond the immediate control of ACOA and the Event organizers; and other undefined, not readily foreseeable and presently unknown risks and dangers (“Risks”). I understand that these Risks may be caused in whole or in part by my own actions or inactions, the actions or in actions of others participating in the Event, or the negligent acts or omissions of the Released Parties defined below, and I hereby expressly assume all such Risks and responsibility for any damages, liabilities, losses or expenses that I incur as a result of my participation in any Event.
3. The swimming races of the Event will be run under the Rules and Regulations set forth by the organizing committee, and I agree to be familiar with and to abide by said Rules and Regulations, including any safety regulations and safety regulations established by the City of Long Beach {“City”). I accept sole responsibility for my own conduct and actions while participating in the Event.
4. I hereby Release, Waive and Covenant Not to Sue, and further agree to Indemnify, Defend and Hold Harmless ACOA, the City of Long Beach, event hosts, event employees and event volunteers,  event sponsors, event advertisers, public safety agencies and other public entities providing support for the Event; and each of their respective parent, subsidiary and affiliated companies, officers, directors, partners, shareholders, members, agents, employees, and volunteers (individually and collectively, the “Released Parties”), with respect to any liability, claims, demands, causes of action, damages, loss or expense (including court costs and reasonable attorneys’ fees) of any kind or nature (“Liability”) which may arise out of, result from, or relate in any way to my participation in the Event, including claims for Liability caused in whole or in part by the negligent acts or omission of the Released Parties.
5. I hereby warrant that I am of legal age and competent to enter into this Agreement, that I have read this Agreement carefully, understand its terms and conditions, acknowledge that I will be giving up substantial legal rights by signing it (including the rights of my spouse, children, heirs and next of kin, and any legal and personal representatives, executors, administrators, successors, and assigns.  I acknowledge that I have signed this Agreement without any inducement, assurance, or guarantee; and intend for my signature to serve as confirmation of my complete and unconditional acceptance of the terms, conditions and provisions of this Agreement. This Agreement represents the complete understanding between the parties regarding these issues and no oral representations, statements, or inducements have been made apart from this Agreement. If any provision of this Agreement is held to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this Agreement and shall not affect the validity and enforceability of any remaining provisions.
COVID-19 Waiver and Release
By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that I may be exposed to or infected by COVID-19 while participating in the Event and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at the at the Event may result from the actions, omissions, or negligence of myself and others, including, but not limited to ACOA, the City of Long Beach and their respective employees, volunteers, and program participants and their families (the “Released Parties”). I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to me (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I, may experience or incur in connection with my participation in the Event.
I agree that if I have a fever, cough, feel short of breath or am experiencing any other symptoms or have knowingly been exposed to a communicable disease such as COVID-19 or have traveled to or from a highly impacted area, I will not participate in the Event.  In addition, if I discover that I have been exposed to a suspected or positive case of COVID-19 or have tested positive for COVID-19, I will not participate in the Event.
On my behalf, I hereby release, covenant not to sue, discharge, and hold harmless ACOA, the City of Long Beach, and their employees, agents, and representatives, from any claims,  actions, damages, costs or expenses of any kind arising out of participation in the Event relating to any COVID-19 infection regardless of whether the infection occurs before, during, or after participation in the Event.

I have read this agreement and fully understand its terms. I understand that I have given up substantial rights by signing it, and sign in it freely and voluntarily without any inducement.
