Release of Liability, Acceptance of Responsibility and Acknowledgement of Risk

THIS DOCUMENT AFFECTS YOUR LEGAL RIGHTS.

YOU MUST READ AND UNDERSTAND IT BEFORE DIGITALLY CHECKING OFF AND SIGNING IT.

In exchange for participation in activities and use of property and facilities of and at Kauai North Shore Community Foundation dba North Shore Give (“Foundation”), Princeville at Hanalei Community Association (“PHCA”), the Princeville Makai Golf Club (“Makai"), and the Princeville II Community Association (“P2CA”), I acknowledge and agree, promise and covenant with the Foundation, PHCA, P2CA, Makai, and all other persons or entities and release and discharge the Foundation, PHCA, P2CA, Makai, their agents, employees and/or persons or entities on behalf of my heirs assigns, personal representative and estate, its officers, directors, representatives and members and the Event’s other sponsors and helpers of all kinds as follows:

ACKNOWLEDGEMENT OF RISKS

I understand and acknowledge that the activity I am about to voluntarily engage in bears both known risks and unanticipated risks which could result in injury, death, illness or disease, physical or mental, or damage to myself, to my property or to spectators or other third parties. I understand and acknowledge that these risks may result in personal claims against PHCA, P2CA, Makai, and/or the Foundation, their officers, directors, representatives and members and the Event’s other sponsors and helpers of all kinds and/or claims against me by spectators or other third parties. Among these risks are the following:

(1) The nature of the activity – skateboarding, in-line skating, roller skating, biking, walking, hiking, jogging, climbing, swinging, jumping and/or any other similar activity, (2) acts or omissions, negligence in any degree of PHCA, P2CA, Makai, their agents, employees and/or persons or entities and/or the Foundation, its officers, directors, representatives and members and the Event’s other sponsors and helpers of all kinds; (3) latent or apparent defects or conditions in equipment or property supplied by PHCA, P2CA, Makai, or other persons or entities and/or the Foundation, their officers, directors, representatives and members and the Event’s other sponsors and helpers of all kinds; (4) use or operation, by myself or others of equipment or property supplied by PHCA, P2CA, Makai, or other persons or entities and/or the Foundation, their officers, directors, representatives and members and the Event’s other sponsors and helpers of all kinds; (5) acts or omissions of other participants in this activity, employees and agents of PHCA, P2CA, Makai, or other persons or entities and/or the Foundation, their officers, directors, representatives and members and the Event’s other sponsors and helpers of all kinds  ; (6) weather conditions; (7) contact with plants or animals; (8) my own physical  condition, or my own acts or omissions; (9) condition of the properties, roads, pathways, trails, skate facilities, playground structures, sidewalks and surrounding grounds and terrain and accidents connected with their use; (10) first-aid, emergency treatment or other services rendered; (11) consumption of food or drink.
 
I understand and acknowledge that the above list is not complete or exhaustive, and that other risks, known or unknown, identified or unidentified, anticipated or unanticipated, may also result in injury, death, illness or disease, or damage to myself, to my property, or to spectators or other third parties. I expressly accept those risks not specifically listed above as well.
 
ACCEPTANCE OF RISK AND RESPONSIBILITY
Being aware that this activity entails risk of injury to myself and risks of injury to spectators or other third parties as a result of my actions, I agree, covenant and promise to accept and assume all responsibility and risk for injury, death, illness or disease, or damage to myself, to spectators or third parties and their property arising from my participation in this activity. My participation in this activity is purely voluntary; no one is forcing me to participate, and I elect to participate in spite of the risks.
 
RELEASE
 
I hereby voluntarily release and forever discharge PHCA, P2CA, Makai, and/or the Foundation, their officers, directors, representatives and members and the Event’s other sponsors and helpers of all kinds, from any and all liability, claims, demands, actions or rights of action, which are related to, arise out of, or are in any way connected with my participation in this activity, including, but not limited to, the negligent acts or omissions in any degree of PHCA, P2CA, Makai, and/or the Foundation, their agents, employees and/or persons or entities, officers, directors, representatives and members and the Event’s other sponsors and helpers of all kinds, for any and all injury, death, illness or disease, and damage to myself or to my property. I further agree, promise and covenant to hold harmless and indemnify PHCA, P2CA, Makai, and/or the Foundation, their agents, employees and/or persons or entities, officers, directors, representatives and members and the Event’s other sponsors and helpers of all kinds from all defense costs, including attorney’s fees, or from any other costs incurred in connection with claims for bodily injury or property damage which I may negligently or intentionally cause to myself, to spectators and/or other third parties in the course of my use of the properties and facilities of PHCA, P2CA, and Makai, and/or the Foundation, their officers, directors, representatives and members and the Event’s other sponsors and helpers of all kinds. I further agree, promise and covenant not to sue, assert or otherwise maintain or assert any claim against PHCA, P2CA, and Makai, and/or the Foundation, their agents, employees and/or persons or entities, officers, directors, representatives and members and the Event’s other sponsors and helpers of all kinds  for any injury death, illness or disease, or damage to myself or property, arising from or connected with my use of PHCA, P2CA, and Makai properties and facilities or from any claim asserted against me by spectators or other third parties.

In signing this document, I fully recognize that if I am hurt, or if anyone in my care is hurt, or property is damaged while I am engaged in activities or events using the Foundation, PHCA, P2CA, and Makai facilities and property, I will have no right to make a claim or file a lawsuit against PHCA, P2CA, Makai, and the Foundation, or their officers, agents, employees, directors, representatives and members and the Event’s other sponsors and helpers of all kinds, even if any of them negligently caused the bodily injury or property damage.

ACKNOWLEDGEMENT OF THE EFFECT OF THIS RELEASE AGREEMENT
I understand and acknowledge that by initializing and/or signing this document, I have given up certain legal rights and/or possible claims which I might otherwise assert or maintain against PHCA, P2CA, Makai, the Foundation, their agents, employees and/or persons or entities, officers, directors, representatives and members and the Event’s other sponsors and helpers of all kinds, including specifically, but not limited to, rights arising from or claims for the acts or omissions, negligent in any degree, of PHCA, P2CA, Makai, the Foundation, their agents, employees and/or persons or entities, officers, directors, representatives and members and the Event’s other sponsors and helpers of all kinds.

I understand and acknowledge that by initializing and/or signing this document, I have assumed responsibility and legal liability for the claims or other legal demands, including the defense costs, which may be asserted by spectators or other third parties against me as a result of my use of PHCA, P2CA, Makai, and Foundation properties and facilities. I understand and acknowledge that no other insurance is provided to me for this activity. I certify that I have sufficient health, accident and liability insurance to cover any bodily injury or property damage I may incur while participating in this activity, and to cover bodily injury or property damage caused to a third party as a result of my use of PHCA, P2CA, Makai, and Foundation properties and facilities. If I have no such insurance, I certify that I am capable of personally paying for any and all such expenses or liability.

ENTIRE AGREEMENT
I understand that this is the entire Agreement between myself and PHCA, P2CA, Makai, Foundation, their agents, employees and/or persons, officers, directors, representatives and members and the Event’s other sponsors and helpers of all kinds, and it cannot be modified or changed in any way by the representatives or statements of any employee or agent of PHCA, P2CA, Makai, Foundation, or by me.

I agree that all disagreements, mediations and/or problem resolution shall be governed by the law prevailing in the County of Kaua’i, State of Hawaii, USA and that any legal or equitable claim that may arise shall be resolved in the County of Kaua’i, under Hawaii State law.

Furthermore, my digital signature below indicates that:

In consideration of, and as a condition to, being allowed to participate in the Ohana FitFest (the “Event”) presented by the Kaua’i North Shore Community Foundation dba North Shore Give (“Foundation”), the below Participant, or in the case of a minor Participant, the below parent or guardian on behalf of the Participant represents and agree(s) without reservation to all of the following:

1.The undersigned has investigated and understands what the Event entails. The Participant is in good health and in proper physical condition and sufficiently capable to participate in the Event. The undersigned accepts that it is solely the Participant’s responsibility to determine that Participant is sufficiently fit and possesses sufficient fitness and stand-up paddling ability to safely participate in this Event.

2.The undersigned acknowledges and fully understands that each participant will be engaging in activities that involve substantial risk of serious injury or illness, including permanent disability and death, and severe social and economic losses, which might result not only from their own actions, inactions, inexperience or negligence, but the action, inaction, inexperience or negligence of others, the rules of play, forces of nature, or condition of the premises. Further, that there may be other risks encountered that are not expressed herein, or not known to the Foundation or reasonably foreseeable at the below date. The undersigned nevertheless knowingly assumes all of the foregoing risks of participating in the Event (the “Risks”) and hereby accepts personal responsibility for the damages, compensation, reimbursement and/or expenses of all and any kinds following any such injury, illness, loss, temporary or permanent disability, or death, however and by whomever caused, and resulting directly or indirectly, in whole or in part, therefrom (the “Losses”).

3.The undersigned further, on behalf of the Participant and the Participant’s survivors, heirs, administrators and personal representatives hereby irrevocably agrees to release, waive all claims and demands against, discharge, indemnify, hold harmless and covenant not to sue the Foundation, its officers, directors, representatives and members and the Event’s other sponsors and helpers of all kinds for any claim or demand arising by reason of the Participant’s participation in the Event, any of the involved Risks and/ or any resulting Losses.

4.I also waive all claim of rights to photo and other media preservation of the event and agree that the Foundation and PHCA may use them in any manner they choose.
 
I have read and understood all the information provided, and the terms and provisions contained in this Agreement. By my signature below and my attendance at the Event, I irrevocably agree to be bound to each of those terms and provisions. If I am registering anyone other than myself for this Event, I certify that (a) I am signing this Assumption of Risk, Waiver and Release of Liability Agreement on behalf of that person, (b) and at the specific request of that person, and (c) that the person agrees to be bound to each of the terms and conditions of this document.
 
PARENT’S OR GUARDIAN’S SIGNATURE IF APPLICANT IS UNDER 18 YEARS OF AGE
I am authorized and hereby give my permission and consent for the above Participant to engage in the Event and hereby join in all of the above provisions. To my knowledge the Participant is physically able to compete in the Event. A physician or EMT may treat the Participant whenever necessary until other arrangements can be made; and the Event officials and/or member(s) or helpers of PHCA, P2CA, Makai, and the Foundation may, without liability, render first aid if he/she is qualified to do so or if the circumstances reasonably call for it for the expected benefit to the Participant.

I have read this agreement and fully understand its terms. I understand that I have given up substantial rights by signing it, and sign in it freely and voluntarily without any inducement.

PARTICIPANTS UNDER THE AGE OF 18 ARE REQUIRED TO HAVE PARENT SIGN: This is to verify that I, as a parent/guardian with legal responsibility for this participant, do consent and agree to his/her release as provided above of all the Releases, and, for myself, my heirs, assigns, and next of kin, release and agree to indemnity and hold harmless the Releases from any and all liabilities incident to my minor child's involvement of participation in the events as provided above, even if arising from their negligence.
